
Everyone knows that driving a motor vehicle in Indonesia requires a driver's license. A driving license is one of the absolute requirements for every motor vehicle user on the road. This is even regulated in Law Number 22 of 2009 concerning Road Traffic and Transportation (LLAJ).
Therefore, every driver must have a driver's license and always carry it when using a vehicle.
Carrying a driver's license is not only to anticipate if there is a raid conducted by the police at any time.
However, a driver's license is also proof that the driver has met the requirements for driving.
Therefore, when there is a police check, the officer can ensure that the driver has passed the various tests and is fit to drive a car or motorcycle on the road.
Conversely, if the driver cannot show the license to the police, the officer will give a ticket. This includes drivers who have a driver's license but forgot not to bring it.
This is as stipulated in Article 106 paragraph (5) letter b of Law No.22/2009 concerning LLAJ, where if the driver cannot show a driver's license or is left behind, a fine of Rp 250,000 or a maximum imprisonment of one month will be imposed.
Further on related matters, it is also stated in article 288 paragraph (2) of the same law, which reads;
"Every person driving a motor vehicle on the road who is unable to show a valid Driver's License as referred to in Article 106 paragraph (5) letter b shall be punished with a maximum imprisonment of 1 (one) month and/or a maximum fine of Rp 250,000 (two hundred fifty thousand rupiah)".
However, heavier penalties will be imposed for drivers who do not have a driver's license.
"Based on Article 281 of the LLAJ Law, the sanction is a fine of Rp 1 million or imprisonment for a maximum of four months," said Head of Ciracas Traffic Unit AKP Gede Oka Sukamto, Sunday (12/6/2022).
