Pond Owners Around Semarang-Demak Toll Road Project Protest, Project Stalled

Problems related to land affected by the Semarang-Demak Toll Road project, Central Java, have surfaced again.

This time it was the owners of ponds in Terboyo Kulon, Terboyo Wetan and Trimulyo villages in Genuk sub-district, Semarang City, who protested to the government.

How could they not, tens of hectares of their ponds affected by the Semarang-Demak Toll Road project were declared as destroyed land by the Land Acquisition Committee (P2T).

The pond owners also insisted on rejecting the determination of land destruction by P2T on the grounds that their land was still functioning as a location for milkfish, shellfish and shrimp cultivation.

"If it is considered destroyed, it is not true. Because when there was the East Flood Canal (BKT) normalization project two years ago, with the same land and tax object, it was properly valued," said one of the pond owners, Ngatino, as quoted from the report. Tribun-pantura.com, Wednesday (03/11/2021).

So it's no wonder that Ngatino questioned the designation of his and his colleagues' ponds as destroyed land.

Moreover, the area of ponds affected by the Semarang-Demak Toll Road project is around 65 hectares spread across Terboyo Kulon, Terboyo Wetan and Trimulyo villages.

Worse, 10 residents who own 65 hectares of land have yet to receive compensation.

If tens of hectares of land ending-If the land is still considered to be destroyed, the owners will only receive a token of appreciation that is far from a fair amount of compensation.

"Hopefully, the P2T team of Semarang-Demak toll road will still include our ponds as affected land so that we can get proper compensation through appraisalIt's not just a handout," Ngatino added.

Another pond landowner, Joko S. also said that residents agreed to reject the compensation for the determination of land destruction in all ponds affected by the toll road project.

The reason is that the landowners are still carrying out cultivation activities and continue to pay annual taxes until now.

"We reject the determination of land destruction or tali asih as compensation. We demand proper compensation based on appraisal. Juridically, our land is legal, because we pay taxes every year," said Joko.

It should be noted that in order for their land to be designated as land affected by the toll road, the conditions include that the pond must be 90 percent water and 10 percent boundary.

As for the pond boundary, it can be land or other barriers.

"In fact, our ponds are 90 percent water. Until now, we still use it for milkfish, shellfish or shrimp cultivation. So our ponds are still identified," continued Joko.

Furthermore, the National Land Agency (BPN) of Semarang City has actually measured tens of hectares of ponds and there is no dispute with residents.

But the P2T of the Semarang-Demak Toll Road project actually designated the ponds as destroyed land, which they clearly opposed.

Meanwhile, the legal counsel of the pond owners, Agus Wijayanto, asked the P2T team to be careful and thorough to determine which land is categorized as destroyed land.

He took the basis of the Regulation of the Minister of Agrarian and Spatial Planning/Head of BPN Number 17 of 2021 concerning Procedures for Determining Land Destruction.

In this regulation, there are several conditions for a land or added land to be designated as destroyed, one of which has changed its shape so that it cannot be identified.

"In fact, residents' pond land can be identified because the boundaries are still there. It can be with soil, bamboo or others," Agus explained.

Not only that, land parcels are declared as defunct if they can no longer be used.

In fact, ponds owned by residents affected by the Semarang-Demak Toll Road project can still be used for milkfish, shellfish or shrimp cultivation.

"So, we will all defend it so that the ponds owned by residents are not categorized as destroyed land. It is possible that we will take legal action to defend the rights of the residents," Agus concluded.
